The short version: Prep99 is an independent study tool, not the exam and not a course.
You buy a personal licence to a pack, once, through the App Store or Google Play; the store handles payment, and refunds go through it. Prep99 promises no exam result, is not a prelicensing course, and keeps your study data on your device.
By installing or using the Prep99 app (the “app”) or the prep99.app website, you accept these terms. If you do not accept them, do not use the app. Nothing in these terms takes away rights that the law grants you as a consumer and does not let you waive, including under the laws of your state or country of residence (see governing law).
Prep99 is an independent study app for the Texas insurance producer exams: the General Lines – Life, Accident, Health and HMO exam and the Life Agent exam. It offers a study plan, practice questions, lessons, flashcards, mock exams in the exam’s format, and a readiness reading. Every question, lesson and explanation is written by us in our own words from the published content outline and the primary sources listed on the sources page.
The app is not the exam, does not contain the questions used on the exam (they are not published), and issues no licence, certificate or result. Prep99 is not a prelicensing or continuing-education course. Texas requires no prelicensing course for these two licenses.
Readiness is not a promise. The readiness band and the score behind it are computed on your device from your own answers in the app, by the method described on the How readiness works page. Readiness is not a prediction of your exam result, and it is not an exam score. Doing well in Prep99 does not mean you will do well on the exam, and we make no representation about your result.

References to the Texas Department of Insurance and to Pearson VUE in the app and on this site describe the exam the app prepares you for, nothing more. Their names are the property of their owners.
We make reasonable efforts to keep the content accurate: Texas-law items are checked against the primary sources, every citation names its source and the date it was read, and corrections are dated. Insurance law, regulations and exam practices change, and errors are possible. If the app and the law or the official exam rules ever differ, the law and the official rules prevail. The app is a study tool; it is not legal, financial or professional advice, and it is not a source of Texas law.
If you find a mistake, use “Report a question” on the question itself (it reaches us anonymously with the exact version of the content; see the privacy policy), or write to us (see contact). We review every report.
We grant you a personal, non-exclusive, non-transferable licence to use the app and its content for your own exam preparation, on the devices associated with the account of the store you bought from: your Apple Account for an App Store purchase, your Google Account for a Google Play purchase. The licence does not allow you to:
All content of the app and of this site, including the questions, lessons, explanations, interface, wordmark and the fox, is original expression protected by copyright and remains ours. The names of third parties are theirs.
The licence is tied to the store of purchase. A purchase on the App Store does not carry over to Google Play, nor the other way round: each store attests its own purchases, and since the app has no account, nothing on our side can connect a purchase in one store to a device on the other.
On the App Store, Apple’s standard Licensed Application End User License Agreement also applies to your licence to the app, and Apple may enforce these terms against you as a third-party beneficiary; where the two differ about the licence of the app itself, Apple’s agreement prevails.
Part of the content is free. The rest is sold as packs, each a one-time purchase: no subscription, no recurring charge. Each pack includes its content in both English and Spanish. TheTexas Life & Health pack includes the Texas Life Agent content, because the Life Agent exam covers a subset of the same topics. The store shows what each pack includes and its price before you buy.
The purchase is concluded with Apple or Google, depending on the store, acting as the seller (merchant of record): the price shown in the store at the time of purchase governs, and the store handles applicable taxes. We have no access to your payment details.
Refunds are handled through the store you bought from, under its own policy, without prejudice to your statutory rights:
To use a pack on another device, or after reinstalling, use Me › Restore purchases in the app, signed in to the same Apple Account or Google Account.
A pack stays unlocked for as long as the app is offered on the store you bought from. The app is built to work offline: content already downloaded and your progress keep working without our server. If we ever decided to stop offering Prep99, we would announce it at least 60 days in advance on this site, and in the app if an update is still being distributed, and keep the purchase-restore service running for at least 6 months after the last sale.
Prep99 is for adults preparing for a professional licensing exam. Where the Texas App Store Accountability Act applies, purchases follow the store’s own age rules, including its parental-approval path for a minor’s account; what the app reads about your age category, if anything, is set out in the privacy policy, and nothing about it is kept. If you are a minor, these terms bind you only with the consent of your parent or guardian, which your store obtains where the law requires it.
The app works without an account, and your study data stays on your device and in your own backups. What leaves the device, and why, is set out in the privacy policy, which forms part of these terms.
To the extent the law allows, the app and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including as to accuracy, fitness for a particular purpose or uninterrupted availability. Some jurisdictions do not allow the exclusion of certain warranties; where that is the case, those warranties apply to the extent the law requires.
To the extent the law allows, our total liability to you for any claim arising from the app or these terms is limited to the amount you paid for the pack concerned, and we are not liable for indirect or consequential losses, including the consequences of not passing an exam (exam fees, delays, lost income or employment), since passing depends on factors outside our control.
Nothing in this section excludes or limits liability that the law does not allow to be excluded or limited, including for death or personal injury caused by negligence, for fraud, or for wilful misconduct or gross negligence. If part of this section is held invalid, the rest continues to apply.
You may stop using the app at any time by deleting it. We may suspend the download of paid content for the purchase concerned in case of a clear breach of the licence (a proof of purchase shared with many devices, or automated extraction of the content, for example), without reducing your rights as a consumer.
These terms are governed by the laws of Spain. Wherever you reside, in Texas or anywhere else, the mandatory consumer protection rules of your place of residence apply to you regardless of this choice, and you may bring a claim before the courts of your own residence where those rules grant it. Nothing here limits the remedies the law of your residence gives you.

If these terms change, the new version is published here with its update date. Continuing to use the app after an update means you accept the version in force. A change that affects a pack you already bought never reduces what that pack includes. Material changes are also announced in the app’s release notes.
These terms exist in English and Spanish. The two say the same things; should they ever differ, the English text prevails.
